Participation conditions

  1. Prize draw organiser

    MISUMI Europa GmbH, Franklinstraße 61-63, 60486 Frankfurt am Main (also referred to hereinafter as the organiser) is the organiser of this prize draw. Participation in the prize draw of the organiser is free of charge and is exclusively based on these participation conditions.

  2. Participation authorisation

    Natural persons aged 18 and above who have subscribed to the organiser's newsletter (“newsletter”) from 1 November 2020 are authorised to take part. Employees of the organiser and its affiliated companies as well as their family members are not eligible to take part in the prize draw. The organiser also reserves the right to exclude people from taking part at its own discretion if there are justified reasons, for example a) in the event of manipulation associated with holding the prize draw, b) in the event of these participation conditions being violated, c) if incorrect or misleading information is provided about participating in the prize draw. You can participate in the prize draw by signing up for the newsletter. By signing up for the newsletter, the participant accepts these participation conditions. The participant must provide his/her data him/herself. It is necessary to provide data so that the participant can be informed of the prize if he/she is successful. The judges’ decision is final.

  3. Duration of the prize draw

    Starting on 1 November 2020, a prize draw will always take place after the end of a three-month period (1 November 2020 – 31 January 2021, 1 February 2021 – 30 April 2021, etc., hereinafter referred to as a “quarter”). All new subscriptions to the newsletter in a quarter will be entered into a prize draw in the first month of the month following the quarter, which will be announced by the organiser in good time before each quarter on the organiser’s newsletter registration page.

    Participation in the prize draw is only possible for new subscriptions to the newsletter. Only one submitted subscription to the newsletter will be entered into the prize draw for each participant. It is prohibited to use several e-mail address to increase your chances of winning. The electronically recorded receipt of the subscription to the newsletter by the organiser is used to check that the entry has been received on time.

  4. Prize and declaring the winner

    The winners will be drawn in a random draw among all participants in the first month following the quarter concerned. The winner may not exchange, collect or receive a cash payment for the prize. Non-cash prizes are sent by post to the address provided by the winner. The organiser will pay the shipping costs. The winner is responsible for paying any taxes due on their prize

  5. Notification

    The winner(s) of the prize draw will be notified by e-mail. If a notification cannot be delivered, the organiser does not have to make any further inquiries and can choose a new winner. If the winner does not get in touch within 4 weeks of receiving the notification of his/her prize, the organiser is also entitled to choose a new winner. Every participant agrees when taking part that his/her name can be published on the Internet and in print media in the event of a win.

  6. Exclusion and early termination

    Participants suspected of technical manipulation of the prize draw will be excluded from the prize draw. The organiser reserves the right to interrupt or terminate the prize draw at any time without prior notice and without stating reasons and to adjust these participation conditions.

  7. Disclaimer

    The prize draw is not affiliated with Facebook, LinkedIn, Twitter and Xing and is not sponsored, supported or organised by the aforementioned parties. The sole contact and person in charge is the organiser.
  8. Liability of the prize draw organiser

    The organiser is not liable for damage caused by errors, delays or interruptions in the transmission of data, faults with technical equipment and the service, incorrect content, loss or deletion of data, viruses or that has otherwise occurred when participating in prize draws unless this damage has been caused by the organiser (its executive bodies, employees or vicarious agents) deliberately or with gross negligence. The aforementioned liability restriction does not apply for injury to life, limb and health and for fraudulently concealed defects.

  9. Data protection regulations

    The participant guarantees that the personal information he/she has provided, especially first name, surname, e-mail address, is true and correct. By participating in the prize draw, the participant expressly agrees that the organiser will store the required data for the purpose of the prize draw. All data is processed in accordance with the applicable data protection regulations. The personal information of the participants will not be passed on to third parties or be made available to said third parties for use without their consent. An exception to this is collecting, storing and using data for the purpose of the prize draw, especially the sending of the prize. If the participant wins, the winner agrees for his/her name to be published in the advertising media used by the prize draw organiser. This includes the announcement of the winner on the prize draw organiser’s website and its social media platforms. The participant can request information on his/her details that are stored by the prize draw organiser at any time, raise an objection to the use of his/her details and request the deletion thereof. A simple letter or e-mail to the organiser will suffice here. After revoking the consent, the collected and stored personal information of the participant will be deleted immediately.
  10. Subcontractor

    The organiser is supported by the external service provider Episerver GmbH, Wallstraße 16, 10179 Berlin, Germany for the technical implementation of the prize draw. The participant confirms that he/she agrees to his/her data being collected by the service provider and being prepared and passed on to the organiser. The subcontractor will not forward the data to other third parties.

  11. Severability clause

    Should one of the provisions of these participation conditions be or become invalid, in full or in part, this shall not affect the validity of the other participation conditions. The invalid provision will be substituted by a legally valid provision that comes closest to the meaning and purpose of the invalid provision. The same applies if there is a loophole in these participation conditions.
  12. Applicable law and jurisdiction

    This agreement is governed by the laws of Germany excluding the UN Sales Convention (CISG) and construed in accordance with these laws. The parties agree that any legal disputes in conjunction with this agreement will solely be submitted to the competent court at the head office of the prize draw organiser.
