Brexit impact

for MISUMI Customers in UK from January 1st, 2021

 

On 01.01.2021, the transition period ends, and Brexit will happen having immediate effects on various fields of the business between the United Kingdom (UK) and the European Union (EU).

 

After the end of the transition period on December 31st, 2020 the movement of goods with the UK will proceed as with other third countries outside the EU. This means that EU customs law as well as national and European export and import rules and regulations must be observed. Accordingly, it will be necessary to draw up customs declarations, follow the export control regulations and where applicable, apply for export/import permits. In addition, customs duties may also apply, since preferential origin is not going to be applicable for the UK customers from January 1st ,2021.

 

Accordingly, MISUMI reserves the right to implement necessary adjustments and reflect the new rules to our customers as well. We would like to inform you about the additional processes that you should keep in mind to comply with our requirements for the post-Brexit process.

 

Consideration should therefore be given to the following, among other things.

The following points are impacted by Brexit

1. Payment Terms

From January 1st, 2021 MISUMI will continue to offer the same payment terms of sales on credit and PayPal. MISUMI also reserves the right to adjust the payment terms, currency used, payment method, as well as any further necessities to be adapted.

2. VAT-ID

From January 1st, 2021, the UK is no longer an EU state therefore please be informed that there will be no VAT-ID required for UK Customers. They may fill out their own local tax numbers if they would like to, however this is not a requirement for MISUMI. 

3. Additional Freight costs

MISUMI aim to maintain the current freight costs to the UK, however due to the current unknown factors regarding the freight situation, MISUMI reserves the right to adapt the freight costs and to inform you in due time. 

4. Increase of Leadtime due to customs process

MISUMI do not expect any delays on export procedures and shipping goods on time, however additional delays may occur due to the new customs, duties etc in the UK. Any further changes will be informed to you in due time. Please be informed that any damages that may be experienced by the customers due to the increased lead times will deemed to be the sole responsibility of the customers. MISUMI does not take any responsibility of any damages, penalties or any further additional expenses that the customers may endure due to above mentioned possible longer lead times.  

5. Commercial Invoices

From January 1st, 2021, UK Customers will now receive commercial invoices instead of delivery notes.

6. Incoterms

We do not arrange concrete Incoterms for non-EU states, instead we have the policy of “Duty-Unpaid”, which means we do not pay the duties, taxes and any other expenses, this is the customers responsibility.

7. HS Code

HS Codes will be displayed on the Commercial Invoice, Quote Confirmation, Sales Order (SO) Confirmation and Invoice.

8. EORI Number of Customs

From January 1st, 2021 UK Customers will need an EORI Number to move goods between the UK and EU so please apply for one if you haven’t already done so. Please be informed that MISUMI’s EORI number is DE50174080000. 

9. Country of Origin of Products

Country of Origin will be displayed in the Sales Order (SO) confirmation and Invoice. 

10. Usage of Preferential Status

Usage of Preferential Status is not applicable for the UK since there has not been any trade agreement concluded. However, if this changes in future resulting in the application of any new standard of rules, we will inform you in due time. 

11. Duty and tax in UK

MISUMI do not take any responsibility for the payments to be done at the duties of the UK, as well as any tax to be paid to the UK. These expenses must be fulfilled by customers themselves. 

12. Customs Clearance in the UK

After Brexit, customs clearance will take place in the UK and should be arranged by the brokers of customers or by customers themselves. MISUMI will not take any responsibility for the fulfillment of these necessities. 

13. Supplier Declaration

Supplier declarations will not be applicable for the UK.

14. Permits from Local Authorities

From January 1st, 2021 it might be necessary for UK customers to obtain additional permits from their local authorities. MISUMI does not take any responsibility in assisting customers to obtain such permits as customers are expected to fulfill their local requirements themselves.

15. Export and Import Control

From January 1st, 2021 customers will have the obligation to ensure and follow the export and import control regulations themselves.

16. Sanctioned countries, embargoes, products and usage controlled by export control regulations

Customers have the obligation to follow the applicable regulations and to make sure that their internal processes if applicable, are compliant with the sanctions, screening systems and relevant permits. In addition, customers are obliged to pay attention and to be compliant with the rule that selling MISUMI products to sub-customers who have military purposes etc. is strictly forbidden.

17. Compliance Declaration

From January 1st ,2021 due to export control regulations, UK customers will be required to complete the Compliance Declaration for Customs and Export Control Document during the MISUMI registration process. MISUMI reserves the right to suspend the registration of a new customer until this declaration is completed and sent to MISUMI in due time. If the declaration is not received within five (5) working days, the registration request of the relevant customer will be deleted. MISUMI also reserves the right to analyze the submitted information within the declaration and to decide, whether the customer may register at MISUMI or not, as well as to determine, which products might be allowed to UK customers and which not. 

18. Return process of defected goods

From January 1st, 2021 the returns procedure of defected goods will change. If customers are eligible for returns according to the returns policy stated on the MISUMI website, in addition to the usual complaint procedure, customers will have to prepare additional documents too. Also, depending on the value of goods it may be necessary that the customers will have to submit a customs declaration from the UK to the EU at their own local customs authority and register the transaction in the customs system. As soon as the necessary registration is made, the goods are then handed over to the responsible party’s forwarder with all the documents. Depending on the responsibility, there will be duties and taxes that either the customers or MISUMI will have to bear, provided that the complaint is accepted.

19. Compliance with the laws

We guarantee to observe the legal changes regarding UKCA, Reach and RoHS in UK and to deliver the products to UK in accordance with the current legislation and regulations.
